I. General

When you use Day'n Taxi, you entrust us with your personal data. We are committed to maintaining that trust. Therefore, we first want to help you understand our privacy practices.

In this privacy statement, we describe what personal information we collect, how it is used and shared, and what choices you have regarding that information. We encourage you to read this text in conjunction with our Privacy Overview, which explains the key points of our privacy practices.

Where the term Day'n Taxi is used here, this simultaneously covers and refers to the current operating company of the Day'n Taxi app, QuitSoft GmbH.

II. Overview

 

A. Scope

This Privacy Policy applies to users of Day'n Taxi's services worldwide, including users of apps, websites, features or other Day'n Taxi services.

This Privacy Policy describes how Day'n Taxi collects and uses personal information. This Privacy Policy applies to all users of our apps, websites, features or other services around the world, unless covered by a separate privacy policy. In particular, this Privacy Policy applies to:

Passengers: individuals who order or use cab services, including users of cab services ordered by another person

Cab drivers: individuals who provide rides to passengers themselves or through partner cab companies

This Privacy Policy governs the further collection of personal data by Day'n Taxi in connection with Day'n Taxi services. For example, we may collect contact information from individuals who use Day'n Taxi accounts for business customers. We may also collect personal information from individuals who begin, but do not complete, registration as an affiliate driver. We may also collect personal data in connection with our app technologies and features.

All individuals who are the subject of this Privacy Policy are referred to in this Privacy Policy as "Users."

Our privacy practices are subject to applicable laws in the locations where we operate.

 

B. Data Controllers and Data Transfer

QuitSoft GmbH is the data controller for personal data collected in connection with the use of Day'n Taxi services.

Day'n Taxi operates globally and processes data worldwide. We may also transfer data to countries other than the country where our users live or use Day'n Taxi services. This is to comply with user agreements such as our Terms of Use or is based on prior user consent, resolutions of appropriateness for the relevant countries, or other transfer mechanisms available under applicable law such as standard contractual clauses.

III. Data Collection and Data Use

 

A. Data we collect

Day'n Taxi collects:

Data provided to Day'n Taxi by users, e.g., during account creation.

Data generated during the use of our services, such as location, app usage, and device data

Data from other sources, such as Day'n Taxi partners and third parties using the Day'n Taxi APP.

The following data is collected by or on behalf of Day'n Taxi:

 

1. Data provided by users. This includes:

User profile: we collect data when users create or update their Day'n Taxi accounts. This includes their name, email address, phone number, login name and password, address, profile picture, payment or bank details (including associated payment verification data), driver's license and other official identification documents (which may include document number and date of birth, gender and photo). This also includes vehicle or insurance information of partner drivers, emergency contact information, user preferences, and evidence of health or fitness to provide services through the Day'n cab app.

This further includes gender and/or occupation (when this information is required for certain Day'n Taxi services or programs, such as the "Female Driver Preferred" feature).

We may use photos submitted by users to verify their identity, for example, through facial recognition technologies. For more information, see the "How we use personal information" section.

Background check and identity verification: we collect background check and identity verification data from partner drivers. This may include information such as driver history or criminal record (where permitted by law) and work authorization. This information may be collected by an authorized service provider on behalf of Day'n Taxi.

Demographic Data: We may collect demographic data from users, including through user surveys. In some countries, we may also obtain demographic data about users from third parties.

User Content: We collect information that users submit when they contact Day'n Taxi customer support, provide reviews or compliments to other users, or otherwise interact with Day'n Taxi. This may include feedback, photos or other recordings made by users.

 

2. Data generated during the use of our services. This includes:

Location Data (from partner drivers): Day'n Taxi collects this data when the app is running on the mobile device in the foreground (app open and on screen) or in the background (app open but not on screen).

Location Data (from passengers): we collect accurate or approximate location data from passengers' mobile devices if they allow us to do so. Day'n Taxi collects this data from the time a ride is ordered until it is completed, and each time the App is running in the foreground of that mobile device. We use this data to improve the user experience of our apps. This includes improvements regarding pickup locations, enabling security features, and fraud detection and prevention.

Day'n Taxi collects location data from partner drivers and links the location data collected during a ride to that passenger's account, even if the passenger has not allowed us to collect location data on their device. This allows us to provide services to the passenger such as receipt generation and customer support.

Transaction Information: We collect transaction information related to the use of our services, including the services ordered or offered, the order information, the date and time of the service used, the due amount, the distance traveled and the means of payment. Additionally, should someone use your promotional code, we may link your name to that person.

Usage Data: We collect data about how users interact with our services. This includes data such as date and time of access, app features or pages viewed, app crashes and other system activity, type of browser, and third-party sites or services interacted with prior to using our Services. In some cases, we collect this data by using cookies, pixels, tags and similar technologies that create and maintain unique identifiers.

Device Data: We may collect data about the devices used to access our Services, including hardware models, device IP address, operating systems and versions, software, preferred languages, unique device identifiers, advertising identifiers, serial numbers, and device movement and mobile network data.

Communications Data: We enable users to communicate with each other and with Day'n Taxi through Day'n Taxi's mobile apps and websites. For example, we enable partner drivers and passengers to call each other, text each other, or send other files (generally without disclosing each other's phone numbers). In order to provide this service, Day'n Taxi collects some data about the calls, messages or other communications, such as the date and time of the communication and its content. Day'n Taxi may also use this data for customer support (including resolving disputes between users), security purposes, improving our products and services, and analytics.

Audio Recordings: In certain countries and where permitted by law, users may make audio recordings during their ride using an in-app feature. These recordings are stored on users' devices in encrypted form and are only transmitted to Day'n Taxi if the respective user sends the recording to customer support in connection with a security incident. 3. Data from other sources. This includes:

User feedback such as ratings, feedback or compliments.

Users who participate in our referral programs. For example, if a user recommends another person, we receive the recommended person's personal data from that user.

Day'n Taxi account holders who order services for or on behalf of other users, or who enable such users to order or use services through their accounts. This includes Day'n Taxi business account holders.

Users or others who provide information in connection with claims or disputes.

Day'n Taxi business partners through which users create or access their Day'n Taxi account, such as payment service providers, social media services, or apps or websites that use Day'n Taxi's API or whose API Day'n Taxi uses.

 

Service providers that help us verify user identity, background check information, and work eligibility for regulatory and safety purposes.

Providers of insurance, vehicle or financial services to partner drivers.

Day'n Taxi may combine data collected through these sources with other data in its possession.

 

B. How we use personal information

Day'n Taxi collects and uses data to enable the provision of reliable and convenient ride services and other services. We also use the data we collect for the following:

To promote the safety of our users and services

For customer support

For research and development

To enable communication between users

To send marketing and non-marketing communications

In connection with legal proceedings

Personal data of users will not be sold or given to third parties by Day'n Taxi for the purpose of direct marketing, unless the user has consented to this.

Day'n Taxi uses the collected data in particular for the following purposes:

 

1. Providing services and functions

 Day'n Taxi uses the collected data to provide, personalize, maintain and improve our products and services.

This includes using the data for the following purposes:

Creating and updating user accounts.

Verifying the identity, background, and work eligibility of partner drivers

Providing transportation and other services

Offer, process, or facilitate payments for our services

Offer, provide, or facilitate insurance, vehicle, billing, or financing solutions related to our services

Track and share trip status

Providing features that allow users to share information with others, such as when passengers submit a compliment for a partner driver, or when they recommend Day'n Taxi to friends, share the fare, or share the estimated arrival time and location with their contacts.

Enable features to personalize users' Day'n cab accounts, such as by creating bookmarks or favorite locations and accessing DeepL previous destinations. Please see the "Choices and Transparency" section of this Privacy Policy for information on how to object to this use of personal data.

Performing internal operations necessary to provide our services. This includes reporting software and operational errors, performing data analysis, testing and research, and monitoring and analyzing trends in user behavior and activity.

 

2. Security and Protection

We use Personal Information to maintain the safety, security and integrity of our Services and Users. This includes:

Screening passengers and partner riders before they use our services for the first time and periodically thereafter. For example, where permitted by law, this takes the form of background checks to ensure that our services are not used by partner drivers who violate safety regulations.

Using data from partner drivers' devices to identify unsafe driving behaviors, such as speeding or sudden braking and acceleration, and informing them of safer driving behaviors.

In certain regions, information from driver's license photos and other photos submitted to Day'n Taxi is used for safety purposes. This includes the real-time ID verification feature, which Day'n Taxi uses to prompt partner drivers to submit a selfie of themselves before going online to ensure that the partner driver using the app matches the profile on file with us. This includes comparing photos on file with us with photos of other users to prevent identity lending, and with photos from public databases to verify the user's identity.

Using device, location, profile, usage and other data to prevent, detect and combat fraud and unsafe activities.

Use user ratings and feedback to promote compliance with our community policies and as a basis for disabling the accounts of partner drivers who have low ratings or have otherwise violated such policies in certain countries.

 

3. Customer Support

Day'n Taxi uses the information we collect (including recordings of calls to customer support after notice to and consent to recording by the user) to provide customer support, including for the following purposes:

Forwarding questions to the appropriate customer support representative.

Reviewing and responding to user concerns

Monitor and improve our customer support responses and processes.

 

4. Research and development

We may use the data we collect for testing, research, analysis, product development and machine learning purposes to improve the user experience. This allows us to improve and enhance the security of our Services, improve our ability to prevent illegal or improper use of our Services, develop new features and products, and provide insurance and financial solutions in connection with our Services.

 

5. Enabling communication between users

For example, a Partner Driver may text or call a Passenger to confirm the pickup location; a Passenger may contact a Partner Driver to recover a lost item.

 

6. Marketing

 Day'n Taxi may use the information we collect to market our services to users. This includes sending users communications about Day'n Taxi's services, features, promotions, sweepstakes, surveys, news, updates and events.

We may use the information we collect to personalize the marketing communications (including advertising) we send. This includes, but is not limited to, communications based on the user's location, past use of Day'n Taxi services, and user preferences and settings.

 

7. Non-marketing communications

Day'n Taxi may use the information we collect to generate and provide receipts to users; to notify them of changes to our TOS, services or policies; or to send other communications that are not for purposes of marketing the services or products of Day'n Taxi or its partners.

 

 

8. Legal Processes and Regulations

We may use the personal information we collect to investigate or resolve claims or disputes related to Day'n Taxi's services, or as permitted by applicable law or required by regulators, government agencies or in the course of official investigations.

 

9. Automated Decision Making

We use personal information to make automated decisions regarding the use of our services. This includes:

Enabling dynamic fare adjustment, which determines the price of a ride based on ever-changing factors, including estimated duration and distance, expected route, estimated traffic volume, and the number of passengers and partner drivers using the Day'n Taxi App at any given time.

Finding suitable partner drivers for users who order cab services. The search is based on availability, proximity and other factors. More information about this process can be found here.

Determining ratings for partner riders and disabling the accounts of partner riders and passengers with low ratings. For more information on how ratings are determined and used, see here for passenger ratings, here for partner driver ratings. You can also find more information in the "Searching for ratings" section below.

Deactivating the accounts of users found to have engaged in fraud or other activities that may cause harm to Day'n Taxi, its users or third parties. In some cases, such as misuse of Day'n Taxi's referral program, such behavior may result in automatic deactivation of the user's account.

Using partner driver location data and communications between passengers and partner drivers to identify cancellation fees obtained or caused by fraud. For example, if this data is used to determine that a partner driver is delaying a passenger's pickup in order to obtain a cancellation, we will cancel the charge by not charging the passenger a cancellation fee and adjust the partner driver's revenue accordingly. Please contact Day'n cab customer support if you wish to object to such an adjustment.

C. Cookies and Third Party Technologies

Day'n Taxi and its partners use cookies and other identifying technologies in our apps, websites, emails, and online advertisements for the purposes described in this Privacy Policy.

Cookies are small text files that websites, apps, online media, and advertisements store on browsers or devices. Day'n Taxi uses cookies and similar technologies for the following purposes, among others:

Authenticating users

Storing user preferences and settings

Determine the popularity of content

To track and evaluate the effectiveness of advertising campaigns

Analyzing page views and trends and gaining basic insights regarding the online behavior and interests of people who interact with our Services

We may also permit others to provide us with call rates and analytics services, to serve advertisements on our behalf on the Internet, and to track and report on the performance of such advertisements. These entities may use cookies, web beacons, SDK and other technologies to identify the device visitors use to visit our website and also when they visit other websites and services.

 

D. Sharing and Disclosure of Data

Some of Day'n Taxi's products, services and features require us to share data with other users, or to do so at a user's request. We may also share data with our affiliates, subsidiaries and partners for legal reasons or in connection with issues or disputes. Day'n Taxi may share the data we collect as follows:

1. To other users

This includes sharing the following data:

Passenger's first name, ratings, and pickup and/or destination location to partner drivers.

Passenger's first name to other passengers on a shared ride. Passengers on a shared ride can also see the destination of other passengers.

We may share data from partner drivers and delivery partners with passengers. This includes the following data: Partner driver's name and photo; make, model, color, license plate number, and photo of the vehicle; location (before and during the ride); average user rating; total number of rides; length of time using the Day'n Taxi app; contact information (subject to applicable laws); and the partner driver's profile, including compliments and feedback from other users.

We also provide Passengers and Delivery Recipients with receipts containing information such as a breakdown of the amounts charged, the Partner Driver's first name and photo, route, and other information required in the country or region where the Partner Driver operates.

As part of Day'n Taxi's referral program, we share personal information of referred users, such as the number of trips, with the referring user to the extent necessary to determine the referral reward.

 

2. At the request of the user

This includes the disclosure of data to:

Other persons at the request of the user. For example, we share a user's estimated time of arrival and location with a friend if requested by that user, or we share ride information if a user shares a fare with a friend.

Day'n Taxi Business Partners. For example, when a user orders a service through a partnership or promotional offer provided by a third party, Day'n Taxi may share certain information with that third party. This may include: other services, platforms, apps or websites that integrate with our API; vehicle providers or services; those with an API or service that we integrate; other Day'n Taxi business partners and their users in connection with promotions, contests or special services.

 

3. To the public

Questions or comments submitted by users via public forums such as Day'n Taxi's blogs or social media pages may be viewable by the public. This includes personal data contained in the submitted questions or comments.

 

4. To the Uber account holder

When a user orders a ride or delivery through someone else's account, we may share information about the order or ride, including real-time location data, with the owner of that account. This occurs, for example, in the following cases:

A passenger uses a ride ordered by a friend or through a family profile.

 

5. With subsidiaries and affiliates of Day'n Taxi

We share data with our subsidiaries and affiliates that assist us in providing services or process data on our behalf.

 

6. With service providers and business partners of Day'n Taxi

Day'n Taxi transfers data to consultants, marketing partners, market research companies and other service providers or business partners. This includes:

Payment processors and intermediaries

Background check and identity verification providers (only partner drivers and passengers paying in cash)

Cloud storage providers

Google, in connection with the use of Google Maps in the Day'n Taxi apps

Facebook, in connection with the use of Facebook business tools in the Day'n Taxi apps and websites

Marketing partners and marketing system providers, including social media advertising services

Data analytics providers

Research partners, including those conducting surveys or research projects in conjunction with or on behalf of Day'n Taxi.

Consultants, attorneys, accountants and other professional service providers

Fleet partners

Insurance and financing partners

Airports

Vehicle solution providers or vehicle suppliers

 

 

7. For legal reasons or in case of disputes

Da'n cab may disclose users' personal information when we believe disclosure is required by applicable law, regulation, operating licenses or agreements, legal process, or governmental request, or when disclosure is appropriate due to security or other concerns.

This includes disclosing personal information to law enforcement officials, public health or other government representatives, airports (when required by airport authorities for proper airport operations) or other third parties when necessary to enforce our terms of use, user agreements or other policies; protect Day'n Taxi rights or property or the rights, safety or property of others; or when claims or disputes arise in connection with the use of our services. If you use someone else's credit card, we may be required by law to disclose personal information to that credit card holder, including cab ride information.

This also includes sharing personal information with third parties in connection with or during negotiations for a merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by another company.

 

8 With Consent

Day'n Taxi may also disclose a user's personal information in ways other than those described in this Privacy Policy if we notify the user of the disclosure and the user consents to it.

 

E. Storage and deletion of data

Day'n Taxi will retain user data for as long as necessary for the purposes described above.

Users may request deletion of their accounts at any time. Due to legal or regulatory requirements, or for the reasons set forth in this Policy, Day'n Taxi may retain User Data even after a deletion request.

Day'n Taxi stores user data for as long as it is necessary for the purposes described above. That is, depending on the category of user to which the data relates, the type of data, and the purpose for which the data was collected, we store different categories of data for different periods of time.

Users can request deletion of their account at any time via the corresponding menu in the Day'n Taxi app or via the Day'n Taxi website (passengers and partner drivers).

After an account deletion request, Day'n Taxi deletes the user's account and data, unless they need to be stored due to legal or regulatory requirements for the purpose of security and fraud prevention or due to a problem related to the user's account. This is the case, for example, in the event of outstanding balances or unresolved claims or disputes. As we are bound by statutory and regulatory requirements, this basically means that we store the account and the user's data for at least 7 years after a deletion request. Passenger data is generally deleted within 90 days of a deletion request, unless it must continue to be stored for the reasons stated above.

 

F. Reasons for processing

We only collect and use personal data when we have a legal basis for doing so. These include processing personal data to provide ordered services and functions, for purposes of the legitimate interests of Day'n Taxi or those of third parties, to comply with legal obligations or based on consent.

We collect and use personal data only if we can rely on one or more legal bases. Such legal bases may vary depending on where users are located, but generally include the processing of personal data:

 

1. To provide the services and features ordered

In order to provide our services, we need to collect and use certain personal data. This includes:

User profile data, which we use for the following purposes: to create and maintain user accounts; to verify the identity of users; to communicate with users about their rides, ride orders, and accounts; and to allow users to make payments or generate revenue

Ride reliability verification information used to verify the eligibility of a newly registered partner rider

Partner driver location data, which we use to track rides and help with navigation

Usage data necessary to provide, optimize, and enhance Day'n Taxi's services, including defining additional services, connecting passengers and partner drivers, and calculating fare and revenue for partner drivers

Transaction information

Customer support information

 

2. For the purposes of the legitimate interests of Day'n Taxi and third parties

This includes the use of personal data to maintain and improve user safety and security. For example, we use personal data to prevent users who have been noticed for inappropriate or dangerous behavior from using our services. To this end, we store, for example, the data of blocked users to prevent them from using the Day'n Taxi apps. In addition, we use usage data to  to prevent passengers and partner drivers with an increased potential for conflict (e.g. due to previous complaints from other users) from being matched.

This also includes purposes such as combating fraud; improving our services; direct marketing; research and development; and enforcing Day'n Taxi's terms of use.

Furthermore, this includes the use of personal data to the extent necessary for the interests of other persons or the public, for example in connection with legal and insurance claims and to protect the rights and safety of third parties.

 

3. To fulfill the legal obligations of Day'n Taxi

For example, in many cities and countries, Day'n Taxi is required by law to collect and store data about users' journeys and to disclose such data to government or other authorities. We collect and use personal information to comply with such laws.

Day'n Taxi may also disclose data to law enforcement agencies in connection with criminal activity or threats to public safety or third party requests in connection with legal proceedings. Day'n Taxi may also disclose data to health authorities when required or permitted by law.

 

4. With consent

Day'n Taxi may collect and use personal data based on users' consent. For example, we collect personal information through voluntary surveys. Responses to such surveys are collected based on consent. They are deleted as soon as they are no longer needed for the purposes for which they were collected.

A user who has consented to the collection or use of his or her personal data may revoke this consent at any time. However, the user will then no longer be able to use services or functions for which the collection or use of the personal data is required.

Day'n Taxi allows users to access and review the data collected by Day'n Taxi through the following options, among others:

Day'n Taxi also allows users to request access to or copies of their data, make changes or updates to their accounts, delete their accounts, or restrict Day'n Taxi's processing of personal data.

 

A. Privacy Settings

The Settings menu in the Day'n Taxi passenger app allows users to set up or update their preferences for sharing their location and receiving mobile notifications from Day'n Taxi. Information about these settings, how to set up or change these settings, and the effects of disabling these settings are explained below.

Location data

Day'n Taxi uses location services from passengers' devices to make it even easier for them to get a ride when they need one. Location information helps us improve our services, including pickup, navigation, and user support.

Passengers can enable or disable the collection of location data about their mobile devices by Day'n Taxi through the "Settings" menu in the Day'n Taxi app. Passengers can enable or disable such collection through their mobile device settings.

Share real-time location (passengers)

Passengers who have enabled Day'n Taxi's collection of location data via their mobile devices can also allow Day'n Taxi to share their location with the partner driver from the time the ride is ordered until the ride begins. This can help improve pickups for partner drivers and passengers, especially in busy areas.

Passengers can enable or disable this feature from the Settings menu in the Day'n Taxi app.

Disclosure of data in case of emergency (passengers).

Passengers who have activated the collection of location data via their mobile devices by Day'n Taxi can also activate the function to share their data in case of emergency so that their data can be transmitted to the emergency services of the police, fire department and ambulance. Such data includes the approximate location at the time of the call to emergency services; the make, model, color, and license plate number of the vehicle; the passenger's name and phone number; the pickup and destination locations; and the name of the partner driver.

Passengers can enable or disable this feature from the Settings menu in the Day'n Taxi app.

Notifications: Account and ride updates

Day'n Taxi sends its users ride status notifications and updates on activity in their account. These notifications are an important part of using the Day'n Taxi app and cannot be disabled.

Notifications: Credits and news

Users can allow Day'n Taxi to send them push notifications about credits and news from Day'n Taxi. Push notifications can be enabled or disabled via the "Settings" menu in the Day'n Taxi app.

 

B. Device access permissions

Most mobile device platforms (iOS, Android, etc.) have defined certain types of device data that apps cannot access without the device owner's permission, and these platforms use different methods to obtain such permission. iOS devices notify users when the Day'n Taxi app first requests permission to access certain types of data, and give users the option to grant or deny permission. Android devices inform users of the desired access permissions before they use the Day'n Taxi app for the first time. In this regard, use of the app is considered consent.

 

C. Search for ratings

After each ride, partner drivers and passengers can rate each other. The average value of these ratings is associated with the user's account and is displayed to other users when providing services to or receiving services from them. For example, passenger ratings are displayed to partner drivers from whom a ride is ordered, and partner drivers' driver ratings are displayed to their passengers.

Through this two-way system, everyone must take responsibility for their behavior. This accountability contributes to a respectful, safe environment for partner drivers and passengers.

 

D. Unsubscribing from promotional messages

Users may opt out of receiving promotional emails from Day'n Taxi here. Users may also opt-out of receiving emails and other communications from Day'n Taxi by following the unsubscribe instructions included in those messages. We may still send users who have opted out of receiving non-promotional communications receipts for rides or information about their account.

 

E. Data Requests

Day'n Taxi provides several ways for users to learn more about how their data is handled, ask questions about it, make comments, and review the data.

Access to Data: Users may request an explanation of the data we collect about them and how we use that data.

Receipt of Data: Users may request a copy of their data that Day'n Taxi collects with their consent or to provide our services.

Modifying or Updating Data: Users can change the name, phone number, email address, payment method, and photo stored in their account through the "Settings" menu of the Day'n Taxi app. They may also request that Day'n Taxi change or update their data, including in cases where they believe that such data is incorrect or incomplete.

Deletion of Data: Users may request deletion of their account at any time via the "Settings" menu in the Day'n Taxi App or via the Day'n Taxi website.

Objections, restrictions and complaints: Users may request that we stop using all or part of their personal information or that we restrict our use of their information. Day'n Taxi may continue to use such data after such objection or request to the extent required or permitted by law.

In addition, depending on their location, users have the right to file a complaint regarding Day'n Taxi's processing of their personal data with the data protection authority in their country. For example, users from the European Union and South America may send such requests to the data protection authority of the country in which they live.

 

V. Privacy Policy Updates

We may occasionally update this Privacy Policy. Use of our Services after an update constitutes consent to the updated Privacy Policy to the extent permitted by law.
